GENERAL: Mr. Felix Floor Inc. reserves the right to change these
terms and conditions of acceptance. These Terms & Conditions apply to all
orders: written or verbal. Placing an order with Mr. Felix Floor Inc.
constitutes the full agreement with these Terms and Conditions.
SERVICE CONTRACT: Mr. Felix Floor Inc. makes every effort to
provide customers with a high quality, timely and satisfying service.
Every customer will receive a written quotation for the service offered by
Mr. Felix Floor Inc.
SCHEDULE OF WORK AND ROOMS PREPARATION: Mr. Felix Floor Inc. will
arrive at customer’s place at the date and time agreed by both parties to
start the work. Customer agrees to prepare rooms for the service: remove
furniture, valuables, fragile items, appliances from the working area to
allow easy access to the floor and to prevent potential damage to the
customer’s property. Customer understands that the floor services require
using of power tools and equipment. Mr. Felix Floor Inc. and its employees
are not responsible for the items left in the room.
ORDER CANCELLATION or RE-SCHEDULE: Customer can cancel the order or
re-schedule the order no later than (3) working days prior to start of the
work. Please make sure that your message is delivered properly and timely.
Please leave your name, your address, your phone number and the date of
scheduled work, so we can properly identify your order and make
appropriate changes in our schedule.
SAFETY: Customer agrees to keep children and pets away from the
working areas. Customer understands that some people might be sensitive to
the wood dust or to the fume from chemicals used during the service. If
you think, you or your family member are at risk, please make sure to stay
away from the working area until the job is done.
PAYMENT: Customer agrees to pay for the service in full as soon as
job is completed and accepted by the customer. The payment should be made
to Mr. Felix Floor, Inc. 4335 Ewing Court, Powell, Ohio 43065. Mr. Felix
Floor Inc. reserves the rights to pursue the appropriate action in order
to recover unpaid amount and remedies from the customer.
IF JOB IS NOT ACCEPTED: If job is not accepted, the customer will
contact Mr. Felix Floor Inc within 10 days after job is completed with the
list of items to be corrected. We will make every effort to correct the
problem to your satisfaction as soon as possible. Failure to report the
problems within 10 days after work is completed constitutes full and
unconditional acceptance of our work, and requires a full payment.
WARRANTY: Products supplied by Mr. Felix
Floor, Inc.: We sell our products
under Manufacturer's warranty. Any claims related to quality of the
product will be addressed to the Manufacturer's or the Distributor's
representative of the product. Upon product inspection they will provide
both the Customer and us with copies of their conclusions. If the product
is confirmed to be defective or not to meet specifications, we will
replace the product within full accordance of the Manufacturer's warranty.
Under no circumstances can we provide any coverage beyond warranties
provided by the Manufacturer. Mr. Felix Floor Inc. will not be able to
replace the product or refund the money if the Manufacturer declines the
claim.
Workmanship Warranty:
Mr. Felix Floor Inc. will we give all of our customers a 12 months
Workmanship Warranty. Workmanship is defined by the manual labor that
necessary to complete a job. Our 12 months Workmanship Warranty does not
include Manufacturer's warranty or normal wear and tear related
problems. Our Workmanship Warranty does not
cover damages caused by the customer negligence, accidents or third party.
The sole intention of our Workmanship Warranty is to be
responsible for problems that are related to our labor and the quality of
that labor.
This Standard Limited Warranty applies and is limited as follows:
1. To the property only as long as it remains in the possession of the
original owner.
2. To the hardwood floors have not been subject to accident, misuse,
abuse, improper care, negligence or damage by 3rd party.
3. To the hardwood floors work that has not been modified, altered, defaced,
or had repairs made or attempted by others.
4. That Mr. Felix Floor, Inc. to be notified within ten (10)
days of first knowledge of defect by owner.
5. That Mr. Felix Floor, Inc. shall be given first opportunity to make any
repairs, replacements or corrections to the defective hardwood floors at no
cost to owner within a reasonable period of time.
6. Under no circumstances shall Mr. Felix Floor, Inc and its employees be
liable by virtue of this warranty or otherwise for damage to any person or
property whatsoever for any special, indirect, secondary or consequential
damages of any nature however arising out of the use or inability to use
because of the construction defect.
Our Workmanship Warranty is automatically expires, if hardwood floors have been
re-worked, modified, altered from its original condition.
Under no circumstances Mr. Felix Floor, Inc. is liable for hardwood
floor damage due to the structural problem of the building and/or
defective framing.
Products supplied by Customer:
Any claims related to the quality of material provided by the customer is
responsibility of the customer. Defective material replacement will
require new price quote and timing.
GUARANTEES:
1. Mr. Felix Floor Inc. guarantees to perform work according to the order.
2. Mr. Felix Floor Inc. guarantees to do the best possible work to the
standard of skill of a reasonably competent supplier of such services
based on American Hardwood Floor Association standard.
3. Mr. Felix Floor Inc. guarantees that we carry worker's compensation
coverage and liability coverage.
4. Mr. Felix Floor Inc. guarantees to provide customer with fair and
professional consultation.
5. Mr. Felix Floor Inc. guarantees to respond to customers complain
promptly.
6. Mr. Felix Floor Inc. guarantees to provide customer with the list of
references upon request.
7. Mr. Felix Floor Inc. guarantees that work is performed by regular full
time employees, not the contractors.
ADDITIONAL CHARGES: Additional charges may require, if customer
changes the original order after material has been purchased and/or the
work is started; for the
repair not covered by our or the manufacturer’s warranty.
LIMITED LIABILITY: Mr. Felix Floor, Inc. and its employees are not
liable for damage or injury caused by its goods, equipment or workmanship
beyond replacement of goods or work specified in the service agreement.
Mr. Felix Floor, Inc. and its employees are not liable for any loss of
customer’s property (money, jewelry, valuables, etc) or damage to the
customer’s property left in the room during the service (furniture,
appliances, antiques, etc). Mr. Felix Floor, Inc. is not liable for
hardwood floor damages caused by customer negligence, improper care, pets,
or 3rd party, or anything that would consider to be incidental or
consequential damages.
FORCE MAJEURE: Mr. Felix Floor, Inc. shall not be liable for
failure to deliver or to the delay in delivery or performance due to any
factor beyond our reasonable control including (but not limited) to act of
God, legislation, war, failure or interruption of supplies, strike or
other industrial action by workers.
DISPUTE RESOLUTION: Any disputes between Mr. Felix Floor, Inc. and
the Customer to be resolved by arbitration pursuant to the Construction
Industry Rules of the American Arbitration Association. The parties agree
to meet in person, in the locality of the project, without counsel, to
attempt to resolve any disputes prior to making a demand for arbitration.
Refusal upon reasonable notice and request to participate in good faith in
a settlement meeting shall result in assessment of fees and costs of
arbitration against such party.
INDEMNITY: Customer agree to indemnify, defend and hold harmless
Mr. Felix Floor, Inc., and its employees from any and all claims,
liability, damages and/or costs (including, but not limited to, attorney
fees) arising from your use of our services which cause damage to the
customer or third party.
